This page details the terms and conditions on which we supply any of the products listed on our website. Please read these terms and conditions carefully before ordering any products from our site. By placing an order for any products on our website, you agree to be bound by these terms and conditions. Your statutory rights are not affected by these terms and conditions.
Throughout our Terms and Conditions, the use of the term ‘We’ or ‘Our’ refers to Brighton & Hove Printing and Design and the use of the terms ‘You’ or ‘Your’ refers to the customer placing an order. The use of the term ‘Us’ refers to both Brighton & Hove Printing and Design and the customer placing an order.
USE OF OUR WEBSITE
We endeavour to maintain our website and keep all content on the site (including prices) up to date at all times. We reserve the right to change content and prices at any time. Human error can occur during content and price updates and if such an error occurs, we will notify you before an order is processed so you can decide if you wish to continue with the order.
We store customer information including name, business name, address and contact details on our website. We store uploaded artwork files on our website. We store no payment information such as credit or debit card details on our website.
We have an SSL Certificate installed on our website. The protocol over which data is sent between your browser and the website that you are connected to is called HTTP. An SSL Certificate provides a more secure version of HTTP and it means all communications between your browser and our website are encrypted.
Websites with this extra level of security are identifiable by the ‘S’ at the end of the HTTP in the website address bar, i.e. ‘HTTPS’. Some web browsers such as Internet Explorer, Firefox and Chrome also display a padlock icon in the address bar to visually indicate that a HTTPS connection is in effect.
THE CONTRACT BETWEEN US
By placing an order through our site, you confirm you are legally capable of entering into binding contracts and that you are 18 years old or over
Placing an order on our website constitutes an offer to us to buy one or more of the products available. All orders are subject to acceptance by us. We will confirm acceptance of your order by an Order Confirmation Email, to the email address that you provide, at the end of the ordering process.
We are unable to issue an Order Confirmation Email until the ordering process is complete. The contract between us will only be formed when we send you the Order Confirmation Email. Once the contract has been formed, the terms of the contract cannot be varied without our prior written consent.
We will make all reasonable endeavours to deliver the correct quantity of products ordered by you. You accept that small variations in respect of quantities are inherent within the printing industry.
You accept that variations in colours are inherent within the printing process. You understand and accept that computer resolutions vary from one system to another and as such we cannot guarantee that the product colours will match those displayed on your computer screen during the ordering process.
Contracts for the purchase of Products through our site will be governed by the laws of England and Wales. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales
REFUNDS & CANCELLATIONS
If we have confirmed an order and taken payment but the order has not gone into production, you can cancel the order subject to an administration fee of £20. This fee covers any work that will have been done processing the order up to that point and any charges we may have incurred processing your payment.
If you have used our artwork design service to design your products and we have begun or completed the design process, it will not be possible to issue any refund for the design service should you decide to cancel your order.
Whether you have used our design service and agreed to use a design that we supply or your own artwork, it is not possible to refund any order where the products are already printed or in the process of being printed.
Due to the nature of the sign off process that we employ, the product we print should match the product specification that we will agree with you before printing begins. If there is any defect in any product we supply that we are responsible for, i.e. the final product does not match the specification that we will have agreed with you before printing begins, we reserve the right to offer a replacement or re-print. If it is inappropriate or unsuitable to offer a replacement or re-print we will offer a full refund for the product that contains the defect. We alone reserve the right to decide if a replacement or re-print is inappropriate or unsuitable. We will not pay any compensation for any inconvenience caused to you or any third party due to any such defect or refund situation.
We do not take any responsibility and will not issue any refund for any damage incurred to any product during transit from the factory to the delivery address provided by you. We use couriers to collect and deliver orders and any damage in transit will be the responsibility of the courier. Please check all packaging on delivery. We recommend you do not accept any damaged goods and notify us immediately if such an incident occurs. If you are unable to reject delivery for any reason, you must sign for the delivery as ‘DAMAGED’. We will always do our best to help you sort out any issues that occur due to damage during transit.
PRICES & PAYMENTS
The price of our products as quoted on our website will be the price that you pay, except in the case of obvious errors. We reserve the right to change prices from time to time and we will update our website accordingly over night with any price changes, to minimise the impact to our customers. Our website contains a large number of products with many variations. Human error can occur during content and price updates and if such an error occurs, we will notify you before an order is processed so you can decide if you wish to continue with the order.
All prices include delivery and VAT excluding specific products that are zero rated for VAT, in line with HMRC rules. For example most flyers and leaflets are free from VAT unless the flyer or leaflet is deemed to have a monetary value, is designed to be written on or is to be kept for future reference. In these cases VAT will be charged. If you order a product that is free from VAT but you submit artwork that requires VAT to be charged inline with HMRC rules, we will contact you immediately and discuss your options. If we have quoted a bespoke price for creating your artwork, this price may be subject to change after 30 days from the date of the quotation.
We require full payment of any order before processing an order through to printing. We accept payment with a debit or credit card via PayPal, or by a transfer from your own PayPal account if you have one to ours.
As we use PayPal to process payments, we do not store any credit or debit card data.
We offer two ‘turn-around time’ options for the production time of your order of 3-4 working days or 7-10 working days, plus one day delivery time. This is volume dependant, very high volumes may take longer to turnaround.
Working days are Monday to Friday excluding UK Bank Holidays and unless there are exceptional circumstances, products will be dispatched for delivery in accordance with the turn-around option you choose when placing an order. We always endeavour to meet turn-around times but they cannot be guaranteed.
We use DPD couriers to deliver all goods and they are sent on a next day service, excluding Inverness, Highlands, Northern Ireland, Isle of Man, Isle of Wight, Paisley and Aberdeen which will be delivered on a two day service.
We rely on you to provide accurate delivery address details. If the courier is not able to deliver due to incorrect delivery address details they will retunr the products back to us. We reserve the right to make an additional charge to re-deliver products to the correct delivery address.
DPD will ask for a signature upon delivery. If anyone other than the named recipient signs for the product at the correct delivery address, but the product is not subsequently delivered on to the named recipient, we will not be held liable as the product has been delivered to the correct address.
If you do not receive your order within the chosen turn-around time plus delivery time as explained above, you must contact us immediately so we can investigate and take the appropriate action. We cannot offer a reprint of an order until 15 days from the date of dispatch. This allows DPD time to investigate and locate any missing order.
OUR DESIGN SERVICE
All bespoke designs that we create as part of our design service are wholly owned by us. We will grant you an exclusive perpetual licence for you to use any bespoke design created for you on your business stationery or advertising materials, provided that you do not re-sell the designs.
We will provide high resolution PDFs of any designs we create for you but we will not provide you with editable files of any designs.
MATERIAL AND INFORMATION PROVIDED BY YOU
Is it up to you to ensure that any artwork you provide is of a suitable quality and format. We provide instructions relating to the preparation and upload process of any artwork and information that you provide. If you do not prepare artwork as specified, the end result may not be to the standards that you expect. We will always work with you to try to ensure that artwork is created to the right standards but we accept no responsibility for poor quality products due to any issue with artwork that you provide.
Any artwork that you upload to our site is done so at your own risk and we recommend that you keep a copy of all material that you upload. We have the right to remove any material uploaded by you
You must not upload any material that will breach any third party rights to such material, unless you have the third parties express consent. We have the right to disclose your identity to any third party claiming that any material uploaded by you to our site constitutes a violation of their rights. We will not be held responsible or liable for any problems, costs or legal obligations arising from you using any materials that breach any third parties rights.
You agree only to provide someone else’s personal information if they have given you express consent to use it in respect of the Products you have ordered.
We give no guarantee or make any representations as to the suitability of any completed work for a particular purpose, whether expressed or implied orally or in writing, except as expressly stated in these terms and conditions.
In the event of any breach of these terms and conditions by us, the remedies to you shall be limited to damages which shall in no circumstance exceed the prices of the goods you have paid for (including delivery costs), except as may be implied by law and except in the case of death or personal injury. We shall under no circumstances be liable for any indirect, incidental or consequential damages.
